Portrait Contract Agreement
AGREEMENT OVERVIEW: This agreement contains the entire understanding between Abbey Bradshaw Photography and the CLIENT. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement that does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have signed a waiver in writing.
COOPERATION: The parties agree to offer full cooperation and communication for the best possible result within the definition of this assignment. Abbey Bradshaw Photography is not responsible if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to Abbey Bradshaw Photography.
HOUSE RULES: While on location the photographer may be limited by the guidelines of the site management. CLIENT agrees to accept the technical results of their imposition on the photographer. Negotiation with the officials for moderation of guidelines is the client’s responsibility; Abbey Bradshaw Photography will however offer technical recommendations.
IMAGES and COPYRIGHTS: The photographs produced by Abbey Bradshaw Photography are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without Abbey Bradshaw Photography's explicitly written permission. Upon final payment by the client, the client has limited copyright ownership of the resulting images which may be used only for personal use. This permission is included with high resolution disks, with which the owner may make prints for personal use and sharing, as well as use for their personal blogs, sites, and social networks. The owner may not re-distribute the disk in any manner. The Client must obtain written permission from, and compensate Abbey Bradshaw Photography prior to the CLIENT, or its friends/ relatives publishing or selling the images for profit.
MODEL RELEASE: The CLIENT hereby grant to Abbey Bradshaw Photography and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the CLIENT and/or additional persons involved in the shoot or event including minors (children under the age of 18), for advertising and any other purpose and in any manner and medium; to alter the same; and to copyright the same. The CLIENT hereby releases Abbey Bradshaw Photography and its legal representatives and assigns from all claims and liability relating to said photographs.
LIMIT OF LIABILITY: In the unlikely event that the photographer is injured or becomes too ill, or has an emergency that prevents her from photographing the event, Abbey Bradshaw Photography will make every effort to secure a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the portrait package. Should an act of God, terrorist or natural disaster prevent Abbey Bradshaw Photography from photographing the event or cancels the event then responsibility and liability is limited to the return of all payments received for the portrait package minus the retainer. The retainer and any payments made may be transferred to a future date if availability allows. Abbey Bradshaw Photography takes the utmost care with respect to exposure, handling, and processing the photographs. However, in the unlikely event that the photographs have been lost, stolen, or destroyed for reasons within or beyond Abbey Bradshaw Photography’s control, Abbey Bradshaw Photography liability is limited to the return of all payments received. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals.
COMPLETION SCHEDULE: Online presentation takes approximately 4 weeks. Printed items and albums will require additional time. All albums, prints and USB will be delivered once all products are completed.
ALBUMS: No changes can be made after final approval.
